MUSKRAT-TEARS: The woman who charges that Fox and Blue Sky stole her concept for a muskrat-squirrel hybrid she called Sqrat and used it as Scrat, bug-eyed critter forever in pursuit of an acorn in "Ice Age" and its sequel, which opens March 31, has taken out an ad on Variety's web site to call attention to the dispute. The makers of the new animated film "Ice Age" are hoping for a blockbuster, but not if one New York entrepreneur has her way. CNN`s Jeanne Moos has a $10 million story that pits a hybrid rodent against a prehistoric mammal.

JEANNE MOOS, CNN CORRESPONDENT (voice-over): What do you get when you cross
a squirrel with a rat? A "Sqrat" fight.
IVY SUPERSONIC, PROMOTER: The first mistake was when they stole my Sqrat.
MOOS: With its animated movie "Ice Age," 20th Century Fox is about to make this character a star.

MOOS: Only this character says Sqrat is hers.
SUPERSONIC: Millions of people associate Ivy Supersonic as the creator of Sqrat. Do they think they can get away with this?
MOOS: Ivy Supersonic is a New York hat designer and promoter. Three years ago, she says she spied a squirrel that looked kind of like a rat. Thus was born her Sqrat.
SUPERSONIC: This is going to be $100 million. I`ve got the next Mickey Mouse.
MOOS: Ivy admits she's no wallflower when it comes to promotion, particularly self-promotion.
Over the years, Ivy churned out Sqrat banners, T-shirts, stickers, even a Sqrat mouse pad and a puzzle.
SUPERSONIC: Is that a nose?

SUPERSONIC: That's the eyes, look.
MOOS (voice-over): She pitched her character to entertainment executives from coast to coast, and then what to her wondering eyes should appear? Scrat, the movie star.

MOOS: Scrat squeaks softly but carries big schtick. There`s the whack-a-Scrat game at the movie's eb site. There are posters, tie-ins to Burger King, books.
SUPERSONIC: I`ve been jacked, Jeanne.
MOOS: As in hijacked, robbed. Ivy is going to court, seeking $10 million bucks, an eight-figure Sqrat. But the folks at 20th Century Fox say their Scrat was created by an award winning animator inspired by a pre-historic mammal known as a leptictidium (ph), and that Ivy' Sqrat is based on copyrighted art of a beaver.
SUPERSONIC: This is the year of the Sqrat attack.
MOOS: In her court papers, Ivy notes both Sqrats have round beady eyes, an elongated snout, a bulbous nose, not to mention the bushy tail that's nowhere to be seen the leptictidium. Ivy spelled Sqrat with a 'q.' The moviemakers used a 'c.'
SUPERSONIC: No matter how you spell the Sqrat, `s'c,' 'sk,' 'sq,' it all spells sqrat.
MOOS: To the movie makers, Ivy is poison.
SUPERSONIC: I`m a multimillionaire, just waiting to get paid.

BIZARRE RODENT SPARKS NUTTY CONTROVERSY

The fur is flying in New York over a hot controversy – whether a bizarre creature spotted in city parks is truly part squirrel and part rat.

The Big Apple rodent has been dubbed the ‘sqrat’ by New York hat designer Ivy Supersonic, the first to lay eyes on the creepy creature.

“I first spotted one in Union Square Park in June 1999 and thought it was just a strange squirrel – until I got closer,” Ivy told the ENQUIRER. “It had black fur similar to a rat, but the body of a squirrel. It had a rat’s face, with beady eyes and a pointy rat mouth – but a big bushy tail like a squirrel. I had never seen anything like it.

“I was stunned. I decided to call it a 'sqrat’. Soon I began seeing sqrats in parks all over the city and other New Yorkers began calling me with sightings, too.”

Some people smell a rat, but if Ivy has her way the sqrat will soon become famous. She’s trademarked a sqrat logo and is urging Mayor Rudy Giuliani to make the critter New York City’s official mascot.

And Mickey Mouse had better watch out – she’s even developing a cartoon show featuring the sqrat.

SPOTTING THE SQRAT

It’s a mutant squirrel/rat advancing across New York City – a rodent with a hip, downtown attitude. And creator Ivy Supersonic, better known for her feathered headgear worn by pop icons like Pamela Anderson, is looking to splat the sqrat on everything from Ts to products that begin with all of the other letters. She’s thinking broadly: plush, interactive games, animated series. With a Sqrat website up and running, Supersonic’s already working on a Sqrat mouse pad.

Supersonic has gained publicity for the ersatz sqrat infestation by questioning NYC mayor Rudy Giuliani’s “handling of the crisis”. She also says comedian Jay Leno mentioned the Sqrat on The Tonight Show.

Hell hath no fury like a milliner scorned. Next year, when Fox releases "Ice Age 2," we'll once again be seeing that irascible half-squirrel, half-rat creature called the Scrat. As we told you when the first "Ice Age" opened, publicist/hatmaker Ivy (Supersonic) Silberstein contends that she invented the Scrat. In 2002, she filed suit in U.S. District Court here, charging Fox with copyright infringement and unfair competition. A judge dismissed her suit in 2003.

Supersonic, a buddy of rockers Tommy Lee and Liam Gallagher, is still plotting an appeal. In the meantime, she's taking her battle to the street — and the sky. She's been plastering L.A. and New York with posters directing potential allies to www.scrat.com, where she explains her case. She's also chartered a plane to pull a banner that shows her wearing nothing but a tiny black G-string.

Supersonic, who's covered her lithe body with various Sqrat-related tattoos, plans to buzz the Fox studio lot today. "I'm a warrior," says Supersonic, who has bought anti-Fox commercials on Comedy Central and MTV. A Fox rep says a U.S. District Court found her claim "completely lacking in merit, and we're confident that the Second Circuit of Appeals will agree and affirm."

IVY SUPERSONIC: And I looked at it and I said, oh, my God. That is no squirrel, that's a Sqrat.
MOOS: Ivy Supersonic swears she saw one in Central Park.
SUPERSONIC: They look like a squirrel, but they have the rat face.
MOOS: Supersonic, a flamboyant hatmaker, was so enamored of the name Sqrat that she spent a thousand bucks to get it trademarked. She's printed up Sqrat T-shirts and Sqrat tattoos. She's hoping the Sqrat will knock off Mickey Mouse.
MICKEY MOUSE: Ladies and gentlemen...
MOOS: The ladies and gentlemen we talked to had never seen a Sqrat.

MOOS (voice-over): True, horses and donkeys have gotten together to produce mules, and cattle plus buffalo equal beefalo. So what are the chances of a squirrel and a rat having a fling and then offspring?
DR. DAN WHARTON, DIRECTOR, CENTRAL PARK WILDLIFE CENTER: Basically, nil. MOOS: Dr. Dan Wharton is the director of the Central Park Wildlife Center. Though rats and squirrels are both rodents, they belong to different families.
WHARTON: Well, she either saw a very bushy rat or more likely saw a very threadbare squirrel.
SUPERSONIC: No.
MOOS: Supersonic won't take no for an answer. Besides...
SUPERSONIC: For me to make my money, for me to sell my animated series, it definitely does not have to exist.
MOOS: Take the jackalope, an imaginary cross between a jack rabbit and an antelope. The town of Douglas, Wyoming, calls itself the home of the jackalope, luring tourists with postcards, pins and hunting licenses featuring the so-called horny bunny. Back in 1939, Doug Herrick taxidermied the first jackalope at the suggestion of a friend.
DOUG HERRICK, JACKALOPE TAXIDERMIST: I never had no idea that they'd ever, you know, would take off like they did.

ICE, ICE BABY: Fox's animated adventure Ice Age got a warm reception from moviegoers over the weekend. The pic debuted at No. 1 with $47.9 million, a record opening for March and the third-best bow ever for an animated film (behind Monsters, Inc. and Toy Story 2). Two other new arrivals had strong debuts: Video-game adaptation Resident Evil opened at No. 2 with $18.2 million and the Robert De Niro-Eddie Murphy knee-slapper Showtime bowed at No. 3 with $15.4 million. Rounding out the top five: The Time Machine (No. 4 with 10.9 million) and We Were Soldiers (No. 5 with $8.8 million).

SCRAT SCUFFLE: Well, not everyone is amused by Ice Age's scene-stealing squirrel-rat hybrid Scrat: A Big Apple hat designer who goes by the name of Ivy Supersonic is suing 20th Century Fox and animation studio Blue Sky for $10 million, claiming the acorn-lovin' rascal is based on a character she created.

Designer sues Fox in scrap over Scrat

A New York hat designer has filed a $10 million complaint against Fox and animation studio Blue Sky, claiming Ice Age star Scrat is based on a character she created. The flamboyant designer, who calls herself Ivy Supersonic, says her squirrel-rat combination, Sqrat, was created as an urban legend, and then pitched to Fox as an idea for a cartoon movie or TV show. Fox would not comment on the lawsuit Sunday. Ice Age director Chris Wedge has credited Scrat to Peter de Sève, a New Yorker magazine cover artist.

The animated film "Ice Age" may get a chilly response from Pamela Anderson, Liam Gallagher, Tommy Lee, Snoop Dogg and other pals of Ivy (Supersonic) Silberstein. She's the designer who in 1999 was featured on CNN and elsewhere in the media for her creation of the Sqrat, an imagined New York City mutation, half squirrel, half rat. "Ice Age," which will be given a premiere at Radio City on Sunday, features a similar critter, the Scrat. Silberstein has filed suit in U.S. District Court against Fox Entertainment and Twentieth Century Fox for copyright and trademark infringement and unfair competition. She seeks $10 million. A Fox spokeswoman did not return calls by deadline.

Ivy Supersonic puts three more planes in the sky today to circle Fox, Vivendi Universal in Los Angeles, and Blue Sky Studios in White Plains NY; this as a gentle reminder to Fox that it was Ivy Supersonic who created Sqrat in 1999. Supersonic takes to the air once more in an effort to reclaim rightful ownership of her cartoon character the Sqrat, trademarked as reported by CNN's Jeanne Moos, February 2000. Fox claims to never have heard of Sqrat, although a picture of the Sqrat was run in Murdoch's NY Post in 2000. In addition License! Magazine verified that 32 Fox executives received their 1999 License! Annual Industry Report which prominently featured Ivy Supersonic's Sqrat. Fox's publicist Meredith Lipsky submitted her testimony in writing to the Southern District Court of NY. Furthermore, Elie Dekel, the executive Vice President of Licensing & Merchandising at Vivendi Universal denies his 1999 conversation concerning the Sqrat character. He is now releasing the Ice Age 2/Scrat video game through Vivendi Universal. Last week Dekel was quoted in Vivendi's press release, as saying, "VUG is a great and proven partner for some of our major theatrical releases. In conjunction with the release of the motion picture Ice Age 2, the release of this outstanding video game brilliantly expands on our Ice Age franchise."Scrat, starring in Ice Age 2, is a stolen character. Fox's nomenclature for the character as "S-c-r-a-t" equates it to a hermaphrodite in accordance with the Webster's Unabridged Dictionary definition thereof.

The question that needs to be answered is: Did Fox choose to name its cartoon character after a hermaphrodite or did the marketing department not do enough research when changing the spelling of Sqrat (Ivy's squirrel/rat) to avoid paying Ivy for the character she created? "Twentieth Century Fox's Ice Age began at the Fox Family level, which just happened to be one of the major studios that I pitched my Sqrat to, back in February 2000. In February 2000, CNN ran the original Sqrat story which established first usage to me, Ivy Supersonic as the creator of Sqrat, part squirrel, part rat. The cartoon character I created for animation for movies and for television. Millions worldwide know Ivy Supersonic as the creator of the urban legend Sqrat and remember that story. That segment was also picked up on Continental Airlines and ran on all international and domestic flights.

"In fact, back in October 1999, my Sqrat was featured for license in the annual report of License! Magazine, which is the bible for all the industry’s licensing deals. I have yet to receive any form of payment or deal memo from Fox for the licensing of my Sqrat, though I am optimistic.

"In June 1999, I was part of the original 'dysfunctional family', a KROCK concert at Jones Beach Theatre, where I "first" displayed my Sqrat banner on stage with the infamous band known as Limp Bizkit before 10,000 or so concertgoers. You and Fox can read about it on my websites at www.ivysupersonic.com, or www.Sqrat.com or www.scrat.com or on a simple Google or Yahoo search, along with a number of other character traits which document my character and my personality. My bio, for instance, says I am 'irreverent' and 'on a mission' and my tag line is 'down for whatever, whenever.' Merely coincidence? That Ice Age is a story about the first 'dysfunctional family,' and on the website for www.iceagemovie.com their Scrat is 'on a mission', and on eBay Twentieth Century Fox's Ice Age is 'irreverent.' If you're on Fox's email list the Scrat is 'down for whatever throughout the weather.' I believe in coincidences and I also believe Fox's Scrat is taking on my personality, the same as my Sqrat was my alter ego.

"Sqrat went through a number of developmental stages, but he was always marketed with intent to be New York City's mascot. So, Sqrat was not only stolen from me, but taken from all New Yorkers as well. I had numerous offers for development deals, and many possibilities, but the deals were never about a logo design or the co-authored script we had written. It was only about the character himself, the Sqrat, part squirrel, part rat. The deals were purely based on character name and identity alone. I saw my Sqrat as the ultimate urban legend, a love story between a squirrel and a rat in New York City, which spawned a very loveable Sqrat – the Sqrat having an identity crisis, stemming from his multicultural and multiracial roots. Kids would identify with the Sqrat who had a real need to fit in, but for obvious reasons could not. Kids were able to learn life lessons from the Sqrat by tackling everyday issues that affect Sqrats and kids everywhere.

"But that's not how it's done in Hollywood with cartoons. They hire their own writers and their own animators and I would have lost creative control. Or one better: what happened in my case... I got jacked and my Sqrat hijacked. I am actually mortified for Fox! Everyone from William Morris to Endeavor, to UTA, to AMG, to ICM, to MTV, to VH1, to HBO (...it's a tremendous list!) all took meetings, my calls, my faxes, my FedExs, my emails, my press kits. They all know what happened and associate me, Ivy Supersonic, as the creator. I was relentless and I will continue to be relentless! I feel like a lost mom whose 'baby' has been kidnapped! Just like the theme of Ice Age... the ending will all work out... the dysfunctional Fox Family will bring the missing child home to its mother.

Scrat Scrap: How does that old Hollywood adage go? Success has many fathers, but failure is an orphan?

Last week, Ice Age made history, taking in almost $50 million at the box office over a March weekend, which only inflamed one Ivy Silberstein, who believes she has a claim on the film's most lovable character, Scrat. He's the saber-toothed squirrel featured in Ice Age's ad campaign. In the film, his silent adventures with a stubborn acorn break up the acts. He probably deserves his own movie or series, all of which comes as no surprise to Silberstein, who sometimes goes by the handle Ivy Supersonic. "My Sqrat has now been made a star," says native New Yorker Silberstein, who spells Sqrat with a q. "He could be the next Mickey Mouse or the star of Ice Age 2."

To that end, she filed a $10 million lawsuit against Fox and the animation studio Blue Sky in February. She contends that in 1999, she invented and trademarked the character, a hybrid of a squirrel and a rat (hence her spelling), as an urban mascot of NYC. "What has happened here is another example of a young entrepreneur with an original idea getting beaten and cheated by corporate America."

Florence Grace, vice president of Fox corporate communications, says the lawsuit "is without merit." She states: "Our character was independently designed by the award-winning animation artist Peter de Seve. His artwork was inspired by a small prehistoric mammal called a Leptictidium. After we discovered that Ms. Silberstein's artwork was copied from clip art of a beaver, we demanded she withdraw her motion seeking to stop the release of our movie, and she did. If Ms. Silberstein nevertheless attempts to pursue her claims, we will defend the action vigorously."

Silberstein insists, "I have a trademark case. There's first-usage infringement." She says she spent two and half months in L.A. pitching her Sqrat to animation houses like DIC (Inspector Gadget) and to television and movie production companies trying to land a cartoon series on TV or on the Web. And at least one of her notions makes a lot of sense. "My hunch the whole time is that Scrat was never in the Ice Age script," she says, "and they began work on him last February or March when I left L.A."

As I reported last week, Scrat was indeed developed after most of the work on the animation was complete. Ray Romano and John Leguizamo had never even seen him until screening the film before its debut. "When someone like Fox creates something," says Silberstein, "they're supposed to have due diligence. They decided to flip the q and change it to a c. They're trying to do everything they can to get away with it. Doing research is very simple." She sighs, "Obviously, they don't care about me. They should have picked someone a little quieter to steal from. This is my child, and they can't just come and steal it." Well, movie fans, images of both characters appear on this page: You decide.

Get ready for the great Scrat Scrap.

The Scrat may be the ultimate New York City creature — half squirrel, half rat. It's also a cartoon character in the upcoming animated feature "Ice Age," with Ray Romano, John Leguizamo and Denis Leary as voices for Pleistocene-era mammals who save a human baby. The movie, set for release in March, is touted by 20th Century Fox as a potential blockbuster, complete with merchandising.

There's just one problem. New Yorkers may remember that Ivy (Supersonic) Silberstein created the Sqrat (as she spelled it) in 1999. In fact, CNN's Jeanne Moos did a segment on Silberstein and her crossbreed that June, reporting that Silberstein had trademarked her cartoon version. Howard Stern featured Silberstein's critter, and so did The National Enquirer, a dozen radio stations and various British newspapers. We also interviewed her about it. The trouble started after Silberstein pitched the Sqrat as a cartoon character — to Fox in L.A., even staying at a Fox executive's house there. "License" magazine then announced the Sqrat's availability.

"Fox thinks I'm just an impoverished girl from New York and that they have all the money behind them and they can step on anybody they want to," Silberstein told us. "But they're going to have to pay. And they're going to have to pay for a long time." Carol Sewell, Fox's senior vice president for publicity, and Daphne Gronich, a Fox trademark attorney, did not return our calls. Blue Sky animation studio executive John Donkin had no comment.

The makers of the new animated film “Ice Age” are hoping for a blockbuster when the film opens on Friday, but one character has them hot under the collar already. Jeannie Moos reports on the fight over a hybrid rodent and a prehistoric mammal.

Reporter: What do you get when you cross a squirrel with a rat? A Sqrat fight.

Supersonic: Well, the first mistake was when they stole my Sqrat.

Reporter: With its animated movie “Ice Age” 20th Century Fox is about to make this character a star. Only this character says Sqrat is hers.

Supersonic: Millions of people associate Ivy Supersonic as the creator of Sqrat. Do they think they can get away with this?

Reporter: Ivy Supersonic is a New York hat designer and promoter. Three years ago, she spied a squirrel that looked kind of like a rat. Thus was born her Sqrat.

Supersonic: This is going to be worth a hundred million dollars. I’ve got the next Mickey Mouse.

Reporter: Ivy admits she’s no wallflower when it comes to promotion, especially self-promotion.
Over the years, Ivy’s churned out Sqrat banners, T-shirts, stickers, even a Sqrat mouse pad and a puzzle. She pitched her character to entertainment executives from coast to coast, and then what to her wondering eyes should appear? Scrat, the movie star.

Hey, buddy, you see any humans go by here?

Reporter: Scrat squeaks softly but carries big shtick. There’s the Whack a Scrat game at the movie’s website. There are posters, tie-ins to Burger King. Books.

Supersonic: I’ve been jacked, Jeannie.

Reporter: As in hijacked, robbed. Ivy’s going to court seeking 10 million bucks in an eight-figure scrap because the folks at 20th Century Fox said their Sqrat was created by an award-winning animator and inspired by a prehistoric mammal known as a Leptictidium, and that Ivy’s Sqrat is based on copyrighted art of a beaver. In her court papers Ivy notes both have round beady eyes, an elongated snout and a bulbous nose, not to mention a bushy tail that’s nowhere to be seen on a Leptictidium. Ivy spelled Sqrat with a “q”; the movie makers used a “c”.

Supersonic: No matter how you’re gonna spell the Sqrat – sc, sk, sq -- it all spells Sqrat.

Reporter: To the movie makers, Ivy is poison.

Supersonic: I’m a multi-millionaire just waiting to get paid.

Reporter: To which 20th Century Fox says she has no case and we’re not giving her a dime. Looks like everyone’s trying to hoard their nuts. Jeannie Moos, CNN, New York.
